$2.8 Million Awarded in X-Ray Installation Case

Three New Jersey X-ray technicians have won monetary awards in a case in which an X-ray service company was found negligent.

The plaintiffs, employees of Princeton Regional Orthopedics, suffered permanent respiratory damage and are now sensitive to fumes and dust, according to their attorney, Steven Blader, principal, Szaferman, Lakind, Blumstein & Blader.

The case, Austin vs. A Walsh Imaging, an X-ray sales and service company in Pompton Lakes, NJ, was adjudicated by a jury in a civil trial in December in New Jersey Superior Court.

The plaintiffs received a jury verdict of $825,000 each plus $117,000 each in prejudgment interest. The damages have already been paid.

Other than the compensation for the plaintiffs' injuries, Blader told DOTmed News, the important issue out of this case was "the recognition that the chemicals used in these X-ray processes can be damaging to a technician's respiratory system."

He successfully argued that the company improperly vented the company's X-ray processor during installation. Chemical exposure from the failed venting led to the plaintiffs' injuries.

The company has not returned DOTmed's call for a comment.
